1. Introduction

We take the protection of your personal data extremely seriously and treat personal data confidentially and in accordance with the General Data Protection Regulation, and in compliance with the country-specific data protection provisions applicable to CCC. Generally speaking it is possible to use our website without giving up personal data. When personal data (for example name, address, telephone number of e-mail addresses) are collected, this is always on a voluntary basis. If processing of personal data is necessary and there is no legal basis for such processing, in general we will obtain consent from the party concerned (data subject).

We point out that the transfer of data over the Internet (e.g. when communicating by e-mail) may be subject to security breaches. Complete protection of data from third-party access is not possible.

Information on the automated processing procedure 

a) Determining the purpose of the data collection, processing or use
CCC is a real estate office which offers services related to the subject of purchase, sale & rental of properties exclusively in the north-east. The data collection, processing and use take place as part of the fulfilment of the aforementioned purposes.

b) The groups of data subjects and the relevant data or data categories are:
Customers and supplier data, and employee data.

c) Recipients or categories of recipients
The aforementioned data may be or are made available to third-party service providers (e.g. architects, lawyers, etc.) if this is necessary for the processing of your enquiry.


Collection of general information

When you access the CCC website, certain general data and information are automatically gathered. These general data and information are stored in the server log files. The following may be collected:

-             Type of web browser,
-             Operating system used,
-             The domain name of your Internet provider,
-             The date and time the website is accessed,
-             The Internet Protocol address (IP address),
-             Other similar data and information

which serve to defend against threats in the event of attacks on our computer systems.These data are exclusively information which does not allow any inference to you as a person to be made. This information is necessary in technical terms, in order to display the contents you request on the website correctly and to place the information necessary for prosecution at the disposal of the law-enforcing authority in the event of a cyber-attack.

Newsletter

On the CCC website users are given the opportunity to subscribe to the company’s newsletter, and in this way CCC periodically informs its customers and business partners of offers at regular intervals.
When you sign up for the newsletter, the data you provide is used exclusively for this purpose. Subscribers may also be informed by e-mail of circumstances that are relevant for the service or registration (for example, changes in the newsletter offer or technical situations).

To register effectively, a valid e-mail address is required. In order to verify that the it is really the owner of the e-mail address who has signed up, we use the “double opt-in” procedure. This confirmation e-mail logs the ordering of the newsletter, the dispatch of the confirmation e-mail and the explicit authorisation of the customer. Data such as the IP address assigned by the Internet Service Provider (ISP) to the computer used by the data subject at the time of the subscription and the time of the registration are collected. The data are not passed on to third parties.

You may withdraw your consent for your personal data to be saved and the use thereof for sending the newsletter at any time. There is a link for this purpose in every newsletter. You can also unsubscribe directly on this website at any time, or inform us of your request in this regard using the contact details given at the end of this data privacy.

 

Contact form

If a data subject contacts CCC by e-mail or using the contact form, the personal data he or she provides are automatically saved. These personal data are not passed on to third parties.

Use of Google Analytics

This website uses Google Analytics, a web analysis service of Google Inc. (hereinafter: Google). Embedded YouTube videos

Some CCC web pages have embedded YouTube videos on them. The operator of the respective plugin is:

Social Plugins

On its website CCC offers you the chance to use so-called “social media buttons”. To protect your data, CCC relies on the “Shariff” solution for implementation, which allows these buttons to be added to the  website solely as graphics containing a link to the corresponding website of the button provider. If you click on the graphic, you are redirected to the services of the respective provider. Only then will your data be sent to the respective providers. If you do not click on the graphic, no exchange will take place between you and the providers of the social media buttons. In order to exchange offers, information, photos and other data and files quickly and easily, we use the WhatsApp service on the smartphone as well as on the PC in the office. If you wish to receive the Service, we require your first name, last name, a valid mobile number and your consent to our privacy policy to verify that you are the owner of the specified mobile number or that the owner agrees to receive the Service. Further data will not be collected. These data will not be passed on to third parties.

You can revoke your consent to the storage of the data, the mobile phone number as well as their use for dispatch at any time. The revocation can be made by WhatsApp message or by email.

Data subject rights

If your personal data are processed you may exercise the following rights vis-à-vis C

a) Right to confirmation
As a data subject you have the right to request confirmation at any time as to whether personal data on you are being processed.

b) Right to information
As a data subject, you have the right to request information at any time, by sending a written enquiry to CCC, as to the data about you that are saved. As a data subject, you have the following claim to information:

  • Purpose of processing
  • Category of personal data
  • Recipients or categories of recipients to whom the personal data are revealed
  • Planned storage period
  • Information on the rights to rectification, erasure, restriction of processing and the right to object to the processing
  • Right to complain to the supervisory authority
  • Origin of the data if not provided by you yourself
  • Existence of automated decision-making including profiling
  • Whether there are transfers to third countries or international organisations


c) Right to rectification
As a data subject you have the right to rectification and/or completion, if the processed personal data concerning you are inaccurate or incomplete. The rectification will be carried out immediately by CCC.

 

d) Right to erasure (right to be forgotten)
As a data subject you have the right to obtain from CCC the erasure of the personal data concerning you where one of the following grounds applies:

  • The personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed
  • The data subject withdraws consent
  • There are  no legitimate grounds for the processing
  • The data subject objects to the processing and there are no overriding legitimate grounds for further processing
  • The personal data have been unlawfully collected
  • The personal data have to be erased for compliance with a particular law
  • The personal data were gathered on a child

You may request erasure of the data unless there is a legal archiving obligation.

e) Right to restriction of processing

As a data subject you have the right to obtain from CCC restriction of processing where one of the following applies:

  • The accuracy of the personal data is contested by the data subject
  • The processing is unlawful and the data subject opposes the erasure of the personal data and request the restriction of their use instead
  • CCC no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defence of legal claims
  • The data subject has objected to processing pending the verification whether the legitimate grounds of the controller override those of the data subject.

f) Right to data portability
As a data subject who has provided personal information to CCC, you have the right to receive these data in a structured, commonly used and machine-readable format. Moreover you are entitled to transmit these data to another controller without hindrance from the company. This is only applicable where processing

  • Is based on consent or a contract and
  • Is carried out by automated means.

g) Right to object
As a data subject you may object to processing of your personal data at any time. Continued processing by CCC shall no longer be authorised, unless:

  • CCC can demonstrate compelling legitimate grounds for the processing which override the interest, rights and freedoms of the data subject, or
  • The processing serves for the establishment, exercise or defence of legal claims

h) Automated individual decision-making (including profiling)
As a data subject you have the right not to be subject to a decision based solely on automated processing. This shall not apply if the decision

  • Is necessary for entering into, or performance of, a contract between data subject and CCC.
  • Is authorised by a law and this law lays down suitable measures to safeguard the data subject’s rights and freedoms and legitimate interests
  • Is based on the data subject’s explicit consent

As a data subject you have the right to withdraw your consent to the processing of your personal data at any time.
